LEGAL
Terms of Service
Effective Date: October 16, 2026
1. ACCEPTANCE AND BINDING EFFECT OF TERMS
These Terms of Service (“Terms”) govern your access to and use of the Lorca Group LLC website (lorcagroup.net) and all professional architectural design, drafting, and consulting services provided by Lorca Group LLC (“Company,” “we,” “our,” or “us”). By accessing this website, communicating with our representatives, or formally engaging our services, you (“Client,” “User,” or “you”) acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms.
2. SCOPE OF SERVICES AND PROJECT AGREEMENTS
Lorca Group LLC provides professional drafting, conceptual design, 3D rendering, and permit plan set preparation. We do not provide licensed architectural stamping, structural engineering, civil engineering, or MEP (Mechanical, Electrical, Plumbing) engineering services.
These Terms establish the overarching legal framework for our relationship. All specific services to be rendered will be strictly governed by a separate, written “Scope of Work,” “Proposal,” or “Service Agreement” executed prior to the commencement of any work. In the event of a conflict between these Terms and the specific Project Agreement, the terms of the specific Project Agreement shall prevail strictly regarding project deliverables and fees.
3. CLIENT OBLIGATIONS AND RESPONSIBILITIES
The Client assumes full responsibility for the accuracy of any third-party boundary surveys, site data, or historical blueprints provided to Lorca Group LLC for reference.
The Client shall obtain, at their own expense, all necessary Homeowners’ Association (HOA) approvals, construction permits, and required site inspections.
The Client is solely responsible for ensuring the selected plan-ready for permit fit within all property setbacks, easements, and zoning restrictions applicable to the specific lot.
4. PROJECT INITIATION, TIMELINES, AND DELAYS
No design or drafting work shall commence until Lorca Group LLC has received a signed Project Agreement and the required initial financial deposit has cleared. Lorca Group LLC reserves the absolute right to decline any project inquiry without obligation or explanation.
Project timelines and delivery dates provided by Lorca Group LLC are professional estimates based upon the information available at the time of intake. Lorca Group LLC shall not be held liable for any project delays resulting from:
Failure by the Client to provide complete, accurate, or timely information (site conditions, property surveys, design feedback).
Periods of review, revision requests, or delayed approvals by the Client.
The performance, scheduling, or delays of third-party consultants, including but not limited to structural engineers, civil engineers, and trade contractors.
Backlogs, extended review periods, or procedural changes instituted by local building departments or municipal authorities.
5. SHIPPING, DELIVERY, AND RISK OF LOSS
Our standard deliverables are fundamentally digital. Final architectural plan sets and renderings will be delivered via a secure digital download link or email attachment in high-resolution, digitally signed PDF format.
If physical, printed copies of the plan set are explicitly included in the Project Agreement or requested by the Client for an additional fee, they will be shipped via a standard commercial carrier (USPS, FedEx, UPS) to the address provided by the Client. Title and risk of loss for physical deliverables pass to the Client upon Lorca Group LLC’s delivery of the physical documents to the carrier. Lorca Group LLC assumes no liability for shipping delays, misrouting, loss, or damage incurred during transit. The Client is solely responsible for all shipping, handling, and expedited courier fees unless otherwise stated in writing.
6. REVISIONS, MODIFICATIONS, AND CORRECTIONS
The specific number of included design revision rounds during the schematic phase is strictly defined in the individual Project Agreement. Any revisions requested by the Client beyond the agreed-upon scope, or any material changes requested after the Client has formally approved the preliminary designs, will be classified as “Additional Services” and billed at Lorca Group LLC’s prevailing hourly rate or under a new negotiated fee.
While Lorca Group LLC endeavors to design in compliance with the Florida Building Code, city inspectors and plan reviewers often interpret codes subjectively. Responses to Plan Check Corrections (comments from the building department) that pertain directly to architectural omissions within our original scope of work will be addressed. However, corrections necessitating substantial redesigns due to unforeseeable zoning changes, third-party engineering conflicts, or evolving municipal interpretations may be subject to additional billing.
7. FINANCIAL OBLIGATIONS AND PAYMENTS
Payment schedules, deposit requirements, and milestone invoices are defined in each specific Project Agreement. Lorca Group LLC typically requires a non-refundable deposit prior to commencing the schematic design phase. Final deliverables (both digital PDFs and physical prints) will only be released upon the receipt and clearance of all outstanding balances.
Invoices not paid within the timeframe specified on the invoice may be subject to a late fee of 1.5% per month (or the maximum allowable rate under Florida law) on the outstanding balance. Lorca Group LLC reserves the right to immediately suspend all design work, withhold deliverables, and cease communication with third-party engineers or municipalities on any project with an overdue balance.
Once the technical documents (PDF plan sets) have been released to the Client, no refunds will be issued under any circumstances.
Lorca Group LLC reserves the right to terminate the agreement if the Client fails to provide accurate, timely information required to complete the plans. In such cases, Lorca Group LLC is entitled to compensation for all services and expenses incurred up to the date of termination.
8. DISCLAIMERS AND LIMITATION OF LIABILITY
Lorca Group LLC provides its services and website content on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to warranties of fitness for a particular purpose or guaranteed permit approval. Building codes are subject to the interpretation of local authorities having jurisdiction (AHJ), and Lorca Group LLC cannot guarantee that plans will be approved without revision.
To the fullest extent permitted by applicable law, Lorca Group LLC’s total aggregate liability to the Client-whether in contract, tort (including negligence), strict liability, or otherwise-shall not exceed the total total fees actually paid by the Client to Lorca Group LLC for the specific project giving rise to the claim.
Lorca Group LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, delay damages, increased construction costs, or loss of use. Furthermore, Lorca Group LLC bears no liability for construction defects, field deviations made by the contractor, or the failure of the final built structure to strictly mirror the architectural renderings.
9. THIRD-PARTY PROFESSIONALS AND DELEGATED ENGINEERING
Lorca Group LLC acts solely as the designer. The Client acknowledges that certain project elements require the specialized services of independent, licensed third-party professionals. Lorca Group LLC assumes no liability, responsibility, or legal exposure for the performance, calculations, errors, or omissions of these independent third parties, which include but are not limited to:
Structural Engineers (PE) performing wind load calculations and structural sealing.
Truss Engineers and Manufacturers.
Civil Engineers providing site, grading, and drainage plans.
Master Septic Contractors or Environmental Engineers.
MEP (Mechanical, Electrical, and Plumbing) Contractors responsible for trade-specific calculations and code compliance.
Land Surveyors providing boundary or topographic data.
Energy Calculations.
Permit Fees & Application Processing.
Material Takeoffs & Costs Estimates.
10. GOVERNING LAW AND VENUE
These Terms of Service, and any disputes, claims, or controversies arising out of or related to a service engagement with Lorca Group LLC, shall be governed by, construed, and enforced in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Orange County, Florida, and the Client hereby consents to the personal jurisdiction and venue of such courts.
11. AMENDMENTS TO THESE TERMS
Lorca Group LLC reserves the right to update, modify, or amend these Terms of Service at any time at our sole discretion. The “Effective Date” at the top of this document reflects the most recent revision. Continued use of lorcagroup.net or our professional services following the posting of any changes constitutes your formal acceptance of the updated Terms.
